The National Fraternal Order of Police (FOP) recently voiced its support for the updated CLARITY Act, specifically backing the latest version of H.R. 3633, also known as the Digital Asset Market Clarity Act. This move came after the FOP reviewed the modified language linked to the Blockchain Regulatory Certainty Act (BRCA), assuring that law enforcement agencies retain their authority to investigate digital asset crimes.
In a July 24 letter to Senate Banking Committee leaders Tim Scott and Elizabeth Warren, the FOP confirmed that their earlier apprehensions were addressed. However, some ambiguity remains, as the BRCA portion of the bill released on Wednesday showed no textual changes, raising questions about which revisions were ultimately made.
FOP Highlights Law Enforcement Protections
The organization analyzed the clarifying language in Section 10604 of the bill, which amends the Blockchain Regulatory Certainty Act. Their conclusion: the legislation does not hinder investigators or prosecutors from pursuing illegal activities involving digital assets. This response directly answers concerns voiced in earlier debates, leading to the FOP's formal endorsement of the bill.

According to the FOP, the ability to temporarily pause transactions could provide investigators key time to prevent fraud, recover stolen funds, and disrupt illegal financial networks.

The FOP's letter also referenced updates to seizure authorities and financial investigations under the Bank Secrecy Act. These changes aim to clarify how digital assets are treated with reporting and enforcement related to monetary instruments. The updated legislation equips law enforcement with more precise tools to handle digital asset crimes effectively.
