Stalled Senate Talks and Lingering Disputes

The CLARITY Act aims to redefine crypto oversight by splitting regulatory authority between the SEC and CFTC, providing clear rules for exchanges, custodians, decentralized projects, and stablecoins. However, Senate negotiations remain gridlocked over several contentious issues, including ethics provisions, DeFi regulation, stablecoin yield oversight, and anti-money laundering enforcement. A recent ethics proposal involving state attorneys general is still under White House review, delaying any potential vote. Senator Cynthia Lummis has incorporated numerous Democratic amendments, but consensus remains elusive with the August recess approaching.

JPMorgan’s analysts, led by Nikolaos Panigirtzoglou, caution that further delays could shift tokenization efforts toward traditional finance players, weakening public crypto networks.
