With just four days left before the Senate recess, the CLARITY Act’s fate hangs by a thread, sitting at a mere 30% chance of approval. If the bill fails to get the necessary votes by July 30, it will be delayed until September, pushing the crypto sector into another year of legal uncertainty.
Senate Gridlock Threatens Bill’s Passage
The bill aims to provide clear federal regulations for cryptocurrencies in the United States but is stalled amid political deadlock. Republicans, who hold 53 Senate seats, need 60 votes to overcome a filibuster, a threshold they seem far from reaching. Among the key obstacles are objections from Democrats, led by Elizabeth Warren, focusing on the ethical safeguards and the law's 2029 sunset clause scheduled to end regulatory authority.
Mitch McConnell’s absence due to hospitalization has further weakened Republican efforts to rally support, forcing a last-minute push by advocates. Alex Thorn, research director at Galaxy Digital, summed up the tension: negotiations need to accelerate immediately or risk losing momentum entirely.
Implications for Bitcoin and Crypto Markets
Bitcoin could see notable benefits if the Act passes. Currently viewed as a commodity by the CFTC, Bitcoin’s status might remain unchanged explicitly, but clarifying the regulatory roles between the SEC and CFTC could shield major exchanges like Coinbase and Kraken from arbitrary lawsuits.
Without this clarity, the SEC may continue to pursue enforcement actions under the guise of unregistered securities sales, similar to its case against Ripple. The Act’s failure would keep this regulatory threat alive, potentially chilling innovation and investment. Conversely, approval could unlock greater institutional interest, notably through spot Bitcoin ETFs, enhancing Bitcoin’s legitimacy as a digital asset on par with traditional stores of value such as gold or the dollar.
The bill’s delay past July 30 places it in direct competition with essential federal funding negotiations and the looming midterm elections, reducing its chances further.
