Senate Majority Leader John Thune flipped course Monday, insisting the chamber will vote on the CLARITY Act before breaking for August recess on the 7th. Just days earlier, on July 23, he had told reporters the crypto bill wouldn't make it to the floor. Now he is bundling it into a packed pre-recess schedule, saying lawmakers will simply stay until the work gets done.
The timing is razor-thin. Four legislative days remain. Bitcoin.com News reported the Senate skipped a scheduled floor vote earlier in the week, burning another day. Push this past August 7 and the vote slides into September, when midterm politics will crowd out bills that haven't already locked in floor time. The bill itself would survive, but momentum matters in Congress.
The Math Problem
Here is where things get complicated. The CLARITY Act needs 60 votes under Senate rules. Republicans hold 53 seats. That means at least seven Democrats have to cross over, and there is no guarantee they will. Treasury Secretary Scott Bessent called the bill the "one-yard line," but Galaxy Research pegged passage odds at just 30 percent this week, down from 50 percent earlier. Prediction markets are split.
The White House and Senate Republicans reached an ethics agreement in late July, with Trump signing off personally. But Democrats say they haven't seen the final legislative text yet. Some argue the language would still leave openings for Trump to profit from his family's crypto interests, which complicates Democratic support even if party leadership wanted to move it.
Thune has made and walked back the same promise before. Whether he delivers this time depends on whether those seven Democratic votes materialize and whether the chamber actually prioritizes a crypto market-structure bill over competing legislation in a compressed window. The next few days will tell.
