Matt Hougan, Bitwise's top investment officer, is betting the crypto industry keeps humming regardless of what happens to the CLARITY Act in the Senate. The landmark digital asset bill stalled this week. No cloture filing materialized before lawmakers headed home for August recess, effectively shelving it from immediate consideration.

That's a brutal setback on paper. Prediction markets dropped the odds of passage this year to around 16%, down from much higher expectations just weeks ago. Senate Majority Leader John Thune never filed to advance the motion, leaving supporters scrambling. Hougan called it a "walking dead state," where the bill lingers but momentum evaporates.

The Market Moves Forward Anyway

Yet Hougan's argument cuts through the noise: institutional adoption, stablecoins, tokenization, and spot ETFs are already reshaping the space independent of any congressional stamp. The bill would clean up regulatory ambiguity, sure, but the forces driving growth don't require it. Exchanges, custodians, and asset managers are building infrastructure around the current ruleset. Smaller firms are hedging bets with the SEC, which continues issuing guidance on its own terms.

The CLARITY Act itself has traveled a winding road. It cleared the House in July 2025, then the Senate Banking Committee in May 2026, landing on the chamber's calendar in June. Even passage in the Senate would demand reconciliation with any House tweaks and a presidential signature. That's a gauntlet, not a finish line.

Hougan's core claim rests on momentum that exists beyond legislation. Institutional money keeps flowing into crypto. Tokenization projects are launching in parallel ecosystems. Stablecoins are becoming payment infrastructure in earnest. These trends don't need Washington's blessing to accelerate, though regulatory clarity would certainly grease the wheels.
