The CLARITY Act was supposed to land before the Senate's August 7 recess. Draft rules hit on July 13, floor action came July 20, leaving roughly four weeks to push through. But Senate filibuster rules demand 60 votes, and Republicans need Democratic support that hasn't materialized. The bill stalled. Now lawmakers won't return until September at the earliest, meaning even a fast track gets you past year-end. Most likely scenario? Nothing moves until 2027.
What CLARITY actually does
The proposal splits oversight between the SEC and CFTC, clarifies which regulator handles exchanges versus derivatives, and attempts to define how decentralized finance gets regulated.
